An out-of-print or unavailable work can be defined as an item that a publisher or retailer can confirm is no longer published and/or not available within a 'reasonable time'. You may reproduce and communicate more than a 'reasonable portion' (including the whole item).

  • A record of all inquiries to the publisher/supplier about the item must be kept.

Distribution (hard copies, CDs, USBs, email attachments)

  • Amount as for reproduction
  • Digital copies must contain Part VB Warning Notice (See Legal Forms, Labels & Notices)
  • If greater than 10%/one chapter, item should carry a note identifying it as an "out of print work".
  • Must be referenced
  • Digital copies must be registered through the eReserve system

Communication online (placing on websites)

  • Amount and conditions as for reproduction
  • Must contain Part VB Warning Notice (See Legal Forms, Labels & Notices)
  • Must be registered through the eReserve system
  • Access must be restricted to staff and students
  • Must be referenced
